I. CONDITIONS OF APPLICATION

1. These terms of sale are concluded on the one hand by GREEK HANDS, located at 4 rue Juge, 750015 PARIS and on the other hand, by any individual or legal person wishing to make a purchase via the website “greek-hands.com” referred to below as “the buyer”.
2. Any order implies the buyer’s full and unqualified adherence to these General Conditions of Sale, which prevail over any other purchase conditions or documents emanating from the Buyer.
3. GREEK HANDS reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in effect on the date of the buyer’s order.
4. These General Conditions of Sale are established in accordance with the principle of transparency that presides over the relationship between GREEK HANDS and the Buyer and form an inseparable whole with the Tariff Terms. They form the basis of the negotiation under section L.441-6 of the Code of Commerce and will be attached to any special agreement between GREEK HANDS and the Buyer.
5. GREEK HANDS may consider non-compliance with existing laws as a legitimate reason for refusing to sell.
6. No special conditions may, except expressly and formally accepted GREEK HANDS, prevail over these General Conditions of Sale. GREEK HANDS is not required to accept conditions or requests that would be abusive or derogatory or exorbitant from these Terms of Sale. In particular, the Buyer refrains from requiring GREEK HANDS to grant conditions revealing a significant imbalance between the rights and obligations of the Parties, in accordance with Article L.442-6 of the Code of Commerce.
7. These conditions apply from the 1st of January 2021.

 

II. PRICES

Prices of ourproducts are shown on the website in euros TTC, excluding participation in processing and shipping costs. GREEK HANDS reserves the right to modify its prices without notice.When ordering, products will be charged based on the rates in effect at the time the order is validated.The discounts shown are valid until stocks run out.The products remain the property of GREEK HANDS until the full payment of the price.

 

III. ORDERS

Availability – Our product offers are valid as long as they are visible on the site, within the limits of available stocks. In the event of a product downtime after your order is placed (stock error, product breakdown), we will notify you by email or phone. We will then offer you the refund of the missing product or products no later than 14 working days after theBuyer’s decision by bank transfer. If the Buyer wishes to have them delivered to them when they are available again, they will have to be ordered later, as GREEK HANDS does not take over the management and delivery of the remaining orders.

Validation of orders -The buyer, who wants to buy a product or service, must:

• Create an account on our website or log in to your account
• fill out the identification sheet on which it will indicate all the contact details requested
• complete the online purchase order by giving all references of the selected products or services.
• validate your order after it has been verified.
• make the payment under the conditions.
• confirm its order and settlement.

Confirmation of the order results in the acceptance of these Terms of Sale, the recognition of full knowledge of them and the renouncement of its own terms of purchase or other conditions. All the data provided, and the confirmed confirmation will be worth proof of the transaction. Confirmation will be worth signing and accepting the transactions performed. The seller will communicate by email confirmation of the registered order.

Orders become firm and final only after acceptance by GREEK HANDS. This acceptance will depend on the stocks available on the date of the order, the production time and the availability of delivery. GREEK HANDS cannot be liable under any circumstances for orders not expressly accepted by it. Unless there is evidence to the contrary, the data recorded by GREEK HANDS is evidence of all past transactions between GREEK HANDS anditsbuyers.

GREEK HANDS reserves the right to refuse any request (including any order) from the Buyer that could cause the disruption of its logistics, financial or administrative services; such a refusal will not give rise to claim or compensation.

 

IV. PAYMENT

You can pay for your purchases in cash:

• By money transfer to the credit of GREEK HANDS’ bank account.
• By PayPal

No payment period is granted, and orders are not sent until the payment has been received and cashed.

Discount codes apply only on the value of the products, which must reach at least the value of the voucher and cannot concern the shipping costs. This offer is not cumulative. Discount codes are not retroactive and can no longer be applied once the order has been placed. The discount codes that give the benefit of the products offered are valid within the limits of available stock. Discount codes are valid until their expiration date.

 

V. DELIVERY

The products are delivered to the delivery address that you indicated during the ordering process. Deliveries are made by adapted carrier and selected by GREEK HANDS.

Orders are shipped within 7 days following their online validation. We are committed to delivering orders to France within 15 days maximum following receipt of payment.

The delivery times shown here are valid for deliveries in Metropolitan France, for working days, excluding problems of postal delivery, and depending on product availability.

If the processing of your order (in particular because of the weight of the packages) required a special routing solution, the delivery times would be specified when you order. If you are not satisfied with these times, you will have the possibility to cancel your order. In the same way in the event of strike of the road carriers, (more generally of any social disturbance), or of climatic incidents, the delivery times could be lengthened.

 

VI. COMPLAINTS AND AFTER-SALES SERVICE

1. Claims do not entitle the Buyer to defer payment of products received by the Buyer and in accordance with the order. In any event, any delay in the product verification procedure reduces the maximum time to pay for products.
2. GREEK HANDS cannot be held responsible for damages caused by an event beyond its control, preventing the normal performance of the sales contract with the Buyer, any event beyond its control being considered a case of force majeure. This will be the case in the event of war, riot, fire, flood, strike, and any other event that could stop, reduce or delay the manufacture or transport of products.

Retraction: buyers have a 14-day period from receipt of their order to exercise their right of withdrawal without having to justify their reasons or pay a penalty.

If the right to withdraw is exercised within the above-mentioned period, we ask you to contact us at contact@greek-hands.com. We will refund the product or products concerned within a maximum of 14 days from the date of the return request.

Shipping and returns cost are at the expense of the buyer. The means of return is the buyer’s choice. Returns are to be made in their original and complete state (packaging, accessories, instructions…). Return address: GREEK HANDS – 5 av. du Beaumontoir, 95380 Louvres. We will not be able to accept returns of products that have been opened or whose packaging has been damaged. No return or product replacement will be accepted for all products after expiration of the use-by date. If these products were nevertheless returned, they would not be accepted nor reimbursed.

Parcels delivered out of time

In the event of failure to meet the delivery deadlines, the buyer has the possibility of cancelling the contract and can request reimbursement of the products ordered as well as the shipping costs. GREEK HANDS will inform the customer as soon as possible of any delay and undertakes to reimburse the entire order (products and shipping costs) to the customer in case of packages delivered outside the deadline.

Return of parcels

In case of return of package, the address provided by the buyer was wrong or the package was put in pending. The carrier will return the package to us. We will notify you as soon as possible. A second shipment can be made against payment by the customer of a flat fee of 12.90 euros. If the customer prefers to cancel his order, it will be refunded excluding shipping costs.

Lost parcels/not arrived

In the event of a loss of a parcel (the carrier misplaced the parcel during delivery and the buyer was never delivered), GREEK HANDS undertakes to ship a second parcel at its own expense.

Defective or damaged products

Complaints about the nature orquality of the products received by the buyer in relation to the order or shipping slip must be made by email to contact@greek-hands.comwithin 48 hours of receiving the products by accurately describing the problem encountered. Failing that, no claim can be validly made and admissible. GREEK HANDS will conduct all useful checks and will ask the buyer, if necessary,for any useful information or photos. Following this, GREEK HANDS will be able to answer favourably or unfavourably to the buyer’srequests. If the response is favourable, we undertake to refund or exchange the apparently defective or damaged products (the re-shipment is the responsibility of GREEK HANDS).

Errors in order preparation

Complaints about the non-compliance of the products received by the buyer in relation to the order or shipping slip must be made by email to contact@greek-hands.comwithin 48 hours of receiving the products by accurately describing the problem encountered. Failing that, no claim can be validly made and admissible. GREEK HANDS will conduct all useful checks and will ask the buyer, if necessary,for any useful information or photos. Following this, GREEK HANDS will be able to answer favourably or unfavourably to the buyer’srequests. If the response is favourable, GREEK HANDS will ask for the return at its own expense of products shipped by mistake.

 

VIII. REIMBURSEMENTS

Refunds of products will be made as soon as possible and no later than 14 days after the date on which the right was exercised.

 

VIII. APPLICABLE LAW – LITIGATION

These General Conditions of Sale are subject in all respects to French law. The language of this contract is the French language. In the event of a dispute, the French courts will have sole jurisdiction.

The Buyer will inform GREEK HANDS as soon as he becomes aware of any action or threat of legal action against him directly or indirectly relating to the products of GREEK HANDS and will not take any action without having first specifically referredto GREEK HANDS (counterfeiting, unfair competition, defective products…). GREEK HANDS will be the sole right to direct the proceedings, to decide on any action to be taken, both with respect to the courts and third parties interested in the case and will not bear the costs of any legal proceedings and negotiations aimed at resolving the dispute or the costs of any award to pay damages only subject to compliance with these General Terms of Sale.

The Parties agree to do their udable to resolve amicably any disagreements that may result from the interpretation, execution, or termination of the commercial relationship between GREEK HANDS and the Buyer.

1. GREEK HANDS is not responsible for any action of a person or an organization, regardless of where they are based, as a result, direct or indirect of the information included or available through this website, regardless of whether this information is provided by GREEK HANDS or a third party.
2. GREEK HANDS does not guarantee, directly or indirectly, that the website content is always updated, safe, without errors, will respond to users’ demands and that the results from its use will be reliable, accurate and without errors.
